✅ Balanced, places responsibility on Client for ongoing content. ⚠️ Risk: ADA/WCAG litigation is growing. Clients may still try to hold you liable even with disclaimers. Recommendation: Strengthen disclaimer: "Service Provider expressly disclaims liability for any claims, damages, or penalties related to accessibility or legal compliance."

  1. Developer Efforts. The Developer will use semantic HTML and make reasonable efforts to follow generally accepted accessibility standards, including the Web Content Accessibility Guidelines (WCAG) as applicable to the scope of the project.
  2. Disclaimer. The Developer does not guarantee full ADA or WCAG compliance, since compliance can depend on factors outside the Developer's control (such as third-party tools, ongoing content updates by the Client, or evolving legal standards).
  3. Client Responsibilities. The Client is responsible for ensuring that any content they create, upload, or update (including images, video, audio, PDFs, and text) continues to meet accessibility standards. The Developer is not responsible for accessibility issues caused by the Client's content or by modifications made after delivery.
